GENERAL TERMS AND CONDITIONS FOR THE SITE AND THE PROPOSED SERVICES

The use of www.maxei.fr implies the full and unreserved acceptance of the terms and conditions of use below. These terms and conditions may be modified or completed at any time. The users of the www.maxei.fr site are therefore invited to consult them regularly.

The site is normally accessible to all users at all times. Interruptions for technical maintenance may however be decided by www.maxei.fr, in which case they will strive to give the user prior notice of the dates and times of the maintenance.

All information given on the www.maxei.fr site is given for information purposes and is likely to change.  Furthermore, the information given on the www.groupe-maxei.com site is not exhaustive. It is given subject to the changes that are made following its publication online..

CONTRACTUAL LIMITATIONS TO TECHNICAL DATA

The internet site cannot be held liable for material damage linked to the use of the site. Furthermore, the site user undertakes to access the site using recent hardware, free of viruses and using a latest generation and updated browser.

COPYRIGHT AND INFRINGEMENT

MAXEI GROUP is the owner of the copyright or has the right to use all the elements that can be accessed on the site, especially the texts, images, logo, icons, sounds, software.

Any reproduction, representation, modification, publication or adaptation of all or part of the site elements, whatever the means or process used is prohibited unless prior written permission is given by:  MAXEI GROUP.

Any unauthorised use of the site or of any of the elements it contains shall be considered to be an infringement and shall be prosecuted under articles L.335-2 and following of the French Copyright Code.

LIMITATIONS OF LIABILITY

MAXEI GROUP cannot be held liable for the direct or indirect damage caused to the user’s equipment when accessing MAXEI GROUP’s site and resulting either from the use of hardware that does not meet the specifications indicated in 4, or from the appearance of a bug or an incompatibility.

MAXEI GROUP can not be held liable for indirect damage (such as the loss of a contract or an opportunity) consecutive to the use of the www.maxei.fr site.

Interactive areas (possibility of asking questions in the contact area) are available to the users. MAXEI GROUP reserves the right to delete all content placed in this area without notice if it is in breach of legislation applicable in France, and especially data protection measures.  When applicable, MAXEI GROUP reserves the right to take civil/criminal proceedings against the user, especially in the event of racist, insulting, libellous or pornographic messages, whatever medium is used (text, photograph, etc.).

PRIVATE DATA

In France, personal data is protected notably by Act n° 78-87 of 6th January 1978, Act n° 2004-801 of 6th August 2004, article L. 226-13 of the French Criminal Code and the European Directive of 24th October 1995.

When using the www.maxei.fr site,the following can be collected: the URL and links the user used to access the www.maxei.fr site, the user’s access provider, the user’s Internet Protocol (IP) address.

In all cases, MAXEI GROUP only collects the user’s personal information for use by certain services provided by the www.maxei.fr site. The user provides this information knowingly, especially by entering the data themselves. At that time the user of the www.maxei.fr site is informed of the duty to provide the information or not.

In compliance with articles 38 and following of Act 78-17 of 6th January 1978 on data privacy, all users have a right to access, correct and oppose their personal data by making a written and signed request to which is attached the copy of a proof of identity showing the holder’s signature, giving the address to which the reply is to be sent.

No personal information from users of the www.maxei.fr is published, exchanged, transferred, or sold on any medium without the user’s knowledge. Only the hypothesis of MAXEI GROUP selling his rights would allow such information to be sent to the possible buyer who would in turn be subject to the same protection and modification rules relative to www.maxei.fr site users .

The site has not been declared to the CNIL because it does not collect personal data.

The databases are protected by the terms of the 1st July 1998 Act enacting directive 96-9 of 11th March 1996 covering the legal protection of databases.

HYPERTEXT LINKS AND COOKIES

The www.maxei.fr site contains a certain number of hypertext links to other sites which have been authorised by MAXEI GROUP. However, MAXEI GROUP cannot check the content of the sites and cannot therefore accept any liability for the said content.

Navigation on the www.maxei.fr site may cause cookies to be installed on the user’s computer. A cookie is a small file which does not make it possible to identify the user but which records information about the navigation of a computer on a site. The data thus obtained is designed to make future navigation on the site easier and is also used to measure certain visit data.

GOVERNING LAW

Any dispute about the use of the www.maxei.fr site is subject to French law. Exclusive jurisdiction is given to the competent Parisian courts.
